Sahara India Pariwar allocated Rs 50 crore for the families of Kargil martyrs

“I’ll either come back after raising the Indian flag in victory or return wrapped in it, but I will come for sure.” And he did come back. The instrumental shell of his valiant soul was wrapped in the glorious tri-colour when he landed on our motherland’s bosom. His family wasn’t saddened by his demise, but honored that their son sacrificed his blessed life in the service of their country. In his father’s own words, he found a righteous path that would lead him to his goal — to a service that was extraordinarily high and supreme.
PVC Captain Vikram Batra’s bravery and act of heroism led to the capture of a peak invaded by Pakistan, Point 4875 in the Mushkoh Valley. On this day of Vijay Kargil Diwas, India celebrates its triumph against the cyphers of terrorism and violence. Most of all, India commends and reminisces the sacrifice of our brave jawans who foiled an insidious attempt of an impure neighbor.
Though their legacy is immortal, only a few people still remember their tales of valor and sacrifice. Sure, Twitter has #VijayKargilDiwas trending, but how many people really care about the Kargil martyrs? A lot of families of these Kargil martyrs didn’t just suffer the loss of a family member. They had to deal with poverty and an insecure future, especially the orphaned children of the war heroes.
In 1999, one of the few private organizations that came forward for the Kargil martyrs and their family was Sahara India Pariwar. There’s rarely any other name that comes to mind, other than Sahara, who actively played an important role after the war. Saharasri Subrata Roy has been supporting over 301 children of the Kargil martyrs’ who are below the age of 18 years.
They have also adopted the families of Kargil martyrs, providing them emotional and economic support. More than Rs 50 crore has been allocated by the company for their help. The patronage didn’t end there. Through their entertainment channel, Sahara televised Mission Fateh, a show where the story of the martyrs were presented without masala, true to every detail.
Apart from Sahara India Pariwar, The Telegraph and Anand Bazaar Patrika set up the Kargil fund, where the common Indian could make a donation. Several Indians like Veni Prakash Khandelwal, who gave away his sagan to the fund, and six-year-old Satrupa Das, who collects money every morning for the same, are also commendable.
Like Lata Mangeskhar suggested, countrymen, let’s take a minute to remember our brave soldiers. Let’s spend a moment in tears for them, who sacrificed their present for our future.

Life Mantras – a manual for positivity

The world at any given point of time is filled with people that are successful and can teach about it to other people so that they too can prosper. Many people have the capability to be that kind of a person but those that actually care about the rest of us are few in number. Mr Subrata Roy is a man that can be considered as a part of the latter group. He is the former chairman of the Indian multinational conglomerate ‘Sahara Group’. ‘Sahara’ is a business empire with interests in various sectors of business and the Subrata Roy is the man who built it from scratch!

He started the company with a few thousand rupees in capital and not more than a few employees. In a relatively short time, Subrata Roy managed to turn the fortunes of the company soaring skywards. He took charge of the company and instilled a specific work ethic among his huge workforce. He looked upon them as members of his extended family rather than people that work for him. This philosophy is what guided him in his path according to his informative book, ‘Life Mantras’.

Mr Subrata penned the book while he was going through a major difficult time in life. Instead of focusing on the negative aspects of his life, he chose to ruminate on the positive qualities in life that made him a successful man and compiled them all into a single book, ‘Life Mantras’. It has some of the best advice to achieve a balanced and positive outlook in life. Along with a positive outlook, the book is filled to the brim with real life experiences of Mr Subrata that had an impact on him or taught him the value of something important. These experiences have been drawn from both his personal life and professional life.

The book has Subrata Roy’s thoughts on almost all the important things in life like marriage, time, love, respect, dedication, resilience, usefulness etc. The mix of topics is eclectic and it has a wonderful effect on your personal motivation after just one reading session.

The secret of staying positive

Almost everyone at some points of time in their lives, have wondered or mused about the ‘secret’ to success. While there are many people who seem to offer advice on that topic with not much to show in terms of credentials, Subrata Roy is an exception. He is a man that has successfully started his own company with very little capital and gradually turned it into one of the biggest companies of the world. ‘Sahara’ is a company that was one of the first Indian companies to have a tangible global presence. It had interests in various sectors and was a thriving and flourishing business that employed millions of people at one point of time.

Subrata Roy is currently penning the sequel to his successful book, ‘Life Mantras’ which was released some time back. ‘Life Mantras’ is a book that is filled with pearls of wisdom relating to success. These pearls of wisdom emanate from Mr Roy’s life as a businessman and his various experiences during his life time. He has generously shared some of those experiences in detail throughout the book. Along with it being an interesting read, it is also a great guidebook to finding success in all the key areas of life.

There are amazing insights in the book about staying positive in life. It also has some meaningful words on handling one’s composure through the tough times. This was and remains to this day, Subrata Roy’s most inspirational quality. He has faced all of his life’s experiences with a great amount of humility and dignity. There are many men that will stand proudly when people talk of
their successes but there are very few men with enough guts to own up to their mistakes and take some responsibility. Subrata Roy has always been the man that takes responsibility for his actions.

He talks about the meaning and importance of ‘responsibility’ in great detail throughout his book, ‘Life Mantras’. Anybody that is looking to add some kind of structure to their lives should read this book. It has guidelines for attaining a peaceful work-life balance that most people can only dream about.

Statement from Sahara's lawyer - Mr. Gautam Awasthi

Pertaining to the today’s hearing of Sahara SEBI case there are few points on which we would like to request you to kindly clarify to your esteemed readers/audience
1.             Hon'ble Supreme Court has directed to prepare and submit a plan of the sale of 86 properties of Sahara of which title deeds are already submitted by Sahara. We would also like to clarify that order is not on the other properties of Sahara and neither these 86 properties includes the foreign properties of Sahara nor Aamby Valley City nor Sahara Star hotel.

2.             Hon’ble Supreme Court directed SEBI that in process of selling properties it has to take inputs and consultation with Sahara.

3.             Meanwhile, today, Sahara has completed the payment of Rs. 5,000 Cr cash component and only Rs. 5,000 Cr bank guarantee component is left. Senior counsel of Sahara, Mr. Kapil Sibal has submitted that since the worth of Sahara’s 86 properties whose original documents are with SEBI for long, is of worth of more than Rs. 40,000 crores and is more than Rs. 5,000 crores of the required Bank Guarantee. The SEBI to get the properties valued and if the admitted valuation is more than Rs. 5000 crore and was contended by Sahara that it should be treated as security and Mr. Subrata Roy Sahara and two Sahara directors be released. To this Hon’ble Court has directed SEBI to work on this proposition

He believes that to achieve true happiness, you have to trust in yourself. It all depends on you. Success is only in your hands. This book will enlighten you with the basic truths with which we are born, and will help you self-motivate every day.
There is so much to learn from the life of Saharasri. He started off as an ordinary man and ended up becoming the most successful businessman in the world. He laid the foundation of Sahara India in 1978 with a capital of only Rs.2000, and within a short span of 37 years this company is worth of Rs.1,80,000 crores. Now, even in his times of adversity he hasn’t given up. He believes in himself completely and thus he looks forward to achieve more and more success each day of his life. Sahara to take legal action against Mirach

Sahara India Pariwar went on the offensive on Thursday accusing Mirach Capital of cheating and forgery in the failed $2.05-billion loan arrangement.

As reported earlier by Mail Today, it has now initiated legal action against the US-based firm and is now working on a new deal to raise funds to secure bail for its chief Subrata Roy.

The crisis-hit group alleged that Mirach and its CEO Saransh Sharma's criminal conduct and lack of financial capabilities to honour such huge commitments led to the breaking down of its deal, leading to precious loss of time, resources and position of Sahara.

"... Sahara is now taking legal action, both of civil and criminal nature, against such gross criminal conduct of MCG (Mirach Capital Group) and their officers, both in India as well as in the US," a Sahara spokesperson said.

He said that an FIR has already been filed in this regard, while adding that the group is now working on another deal and Sahara will comply the order (of the Supreme Court) very soon.

Mirach had on Wednesday formally called off its $2.05-billion loan financing for Sahara and said it has returned the entire due diligence fees of $2.625 million to them. It also accused Sahara of being an unwilling seller for the three overseas properties - The Plaza and Dream Downtown in New York and the Grosvenor House in London.

Shockingly, on January 9, Sharma along with a woman officer was also present in the Supreme Court when Sahara's counsel presented the said letter purportedly issued by Bank of America, based on which the apex court approved the transaction and permitted Sahara to apply to the Reserve Bank of India (RBI) for getting inward remittance in India.

Later on, Bank of America branch manager Nuno Marques informed through his e-mail dated January 31, 2015 that the said letter purportedly issued by him was neither issued nor signed by him. Hence, the letter turned out to be forged.

Subsequently, Sahara sent its officer to the US to confirm the veracity of Bank of America's letter and on February 2 filed an affidavit in the Supreme Court, informing it about these disturbing developments.

Meanwhile, upon inquiry, the Sahara officer confirmed that the Bank of America's letter was a fake, not issued or signed by the branch manager concerned. Thereafter, Sahara confronted Saransh, who was not been able to confirm the veracity of the said BOA letter.

Sebi had received 4,900 refund claims during the August-September exercise from the bondholders of two Sahara companies --Sahara India Real Estate Corp Ltd (SIRECL) and
Sahara HousingInvestment Corp Ltd (SHICL), which had raised over Rs 24,000crore from about three crore investors.

While Sahara maintains it has already repaid more than 93per cent of the outstanding dues directly to the concerned bondholders and the remaining amount was just about Rs 2,500 crore, it deposited Rs 5,120 crore to Sebi in December 2012towards the investor refunds as per Supreme Court orders. Further money has been deposited by the group with Sebi subsequently and it is currently in the process of raisingmore funds to ensure release of its chief Subrata Roy from the jail.

Sebi began the refund process in May 2013, while asking eligible investors to submit their claims. However, the refunds made so far remain minuscule, although the regulator
has not so far made public the quantum of all such payments. Sahara has been maintaining that Sebi should verify the refunds made by it directly and claims to have submitted to
the regulator proof for nearly 75 per cent of refunds. It also says that the remaining 25 per cent refund proof is lying in its Mumbai godown to be given to Sebi.

Sahara also contends that bulk of its investors didn't have bank accounts and other formal financial papers, the details of which have been sought by Sebi. On the identification on Sahara's investors, Sebi has contested in the court that addresses of many investors given
by Saharas were incomplete as only village name, district and state is given without any house number or street/lane names.

On its part, Sahara has maintained that most investors are from rural India and had no house numbers or street names. In the new refund application form, Sebi had given a new
address format for rural investors, asking only village name, post office, district and state as against additional details like house number and street name for urban addresses.

In its latest annual report for the year ended March 31, 2014, Sebi had disclosed having received 3,612 refund applications involving 13,948 deposit accounts till that time in the Sahara matter.
Of those applications, Sebi made refunds in case of 445 applications involving an equal number of deposit accounts for an aggregate amount of about Rs 1.25 crore including interest
of about Rs 43.83 lakh. The other applications had deficiencies or fell under either 'mismatch' or 'multiple investment' category. "Out of the remaining 3,167 applications, in respect of
424 applications involving 1,683 deposit accounts, certain deficiencies were observed in the applications/supporting documents submitted by the applicants which were brought to
the notices of the applicants for their clarification/rectification, and replies are awaited from
them," Sebi said. Sebi also could not process 1,260 applications involving 7,159 deposit accounts as these were in multiple investment category, while 92 cases involving 92 accounts did not meet

the extant refund methodology adopted by the regulator. Besides, 1,776 applications involving 4,395 accounts could not be processed because of being 'mismatch category'.

SAHARA - SEBI: THE MURDEROUS POUND OF FLESH

As funny as it may appear but the Sahara Sebi issue strangely reminds me of
Shakespeare’s “Merchant of Venice”. For those who did not comprehend the
context, I’ll draw the parallel for you. SEBI disguised as the vindictive,
devious Shylock, drags Antonio (in this case Sahara) to reinforce his absurd
claim to Antonio’s 1 pound of flesh (interestingly the pound of flesh here
refers to the approximately 20,000 crores). As readers, we all knew that
Shylock was nothing short of killing Antonio in the court of law. A
befitting analogy to the Sahara Sebi dispute.

As preposterous as the title may sound, the witch hunt against the Sahara
supremo, Subrata Roy Sahara, is inches away of being an ill intentioned
corporate honour killing in progress by the highest authorities perched in
position of power and clout in India. A vicious attempt to execute an entire
corporate just to see it go on its knees bleeding, only to entertain the
prejudicial whims of a few.

Before this takes any form of further elaboration, an immediate look at the
economic quicksand we as an economy are in may add some perspective to what
you all will feed your minds with further down this piece. On one hand,
unemployment, fiscal deficits, an all time low in entrepreneurship and
inflation are some of the fiends we hope to fight off in the ongoing
elections. The gap between the haves and the have nots only deepens. On the
other hand, we have a senseless, irrational litigation running in the courts
against Sahara at the behest of SEBI, which until now has served absolutely
no purpose, lacks any grain of logic or fiscal sensibility and appears to be
making a mockery of our judicial system.

The Supreme Court epitomizes the judicial soul of the country.  An extremely
powerful entity that has the privilege and the clout of imparting judicial
discourse and lending sensibility in much senseless times we live in. What
does not make sense is when these minds of logic and intellect facilitate in
pronouncing judgement and infer, rather impose, guilt upon Sahara without
any grain of proof and assist an absurd claim of a regulator to a pound of
flesh that a) only reveals the regulator’s prejudicial & draconian approach
towards fiscal regulation in a free democratic country and b) severely
impairs the business sensibilities and economics of growth and development.

Subrata Roy, perhaps is the only corporate leader who comes from the region
of UP, Bihar, Rajasthan or MP. He can be attributed to have brought UP onto
the map of corporate leadership apart from its pre-existing electoral might
that UP is already known for. He has infact spawned employment for thousands
of people, catalyzed entrepreneurs, contributed massively to state revenues
and GDP and heavily fuelled CSR initiatives not just at a state but at a
national level too. He has gifted the poor with economic empowerment and
generated a fiscal device of investment and savings for these have nots.

SEBI’s claims about Sahara’s business practices hold no metal & more
dangerously are premised on an assumption. Having failed to verify the
thousands of documents and the veracity of the Sahara investors, SEBI has
assumed to put the blame of its malfunction on an assumption that these
investors are “fictitious”. This coming from the national regulator is an
extremely hazardous premise. How can a regulator be so negligent and
irrational in hurling such grave allegations when they themselves have not
fulfilled the obligations of due diligence that is pending at their end.
Having failed to do so, they have not only declared a war against a
corporate whose business, in the absence of any proof, stands absolutely
legitimate but have also cloaked their incompetency by pronouncing Sahara
guilty. Again, no proof of that too!

Assumptions are dangerous toys in the hands of a mindless child here. It is
the knife with which SEBI intends of extract its pound of flesh. For moment
here, let’s walk into the dangerous premise of that assumption and assume
that SEBI is granted its wish. It takes its pound of flesh of Sahara. Sahara
compromises and pays the disputed amount to SEBI. Now, having done that what
I would really like to know is how does SEBI plans to distribute this money
amongst the investors, who it in the first place, according to SEBI, were
fictitious? More so, if even we assume that by some work of miracle they do
locate these investors, shoves the money down their throats which, to begin
with, these depositors intended to keep invested, where do these depositors
take this money? This question is important because these investors are
daily rickshaw pullers, small roadside vendors and daily wage earners who
probably do not hold a 7 vault safe in their houses. If they have permanent
houses in the first place is also dubious. They are not account holders and
definitely lurking around the poverty line. Has SEBI worked on an alternate
investment plan for these investors if they wish to continue investing their
money? How does SEBI plans to ensure the financial health, whatever little
they may have? For future where do these small depositors go for their
savings because the only avenue they had as Sahara is already standing with
more than its pound of flesh missing and hemorrhaging to death?

A regulator and especially the courts cannot drop the burden of substantial
proof, moral & social obligations of their assessments and most certainly
cannot entertain prejudicial whims and eccentricities. Their roles have been
carved and evolved in a democratic society only to protect, serve and
nurture. Witch hunts and executions have no room where “Where words come out
from the depth of truth, Where tireless striving stretches its arms towards
perfection, Where the clear stream of reason has not lost its way, Into the

dreary desert sand of dead habit...”. Sent on my BlackBerry® from Vodafone
