Statement from Sahara on SAT Proceedings on IRDA order
PRESS NOTE
SAHARA LIFE
INSURANCE SUCCEEDS AGAINST IRDA ORDER
SAT QUASHED IRDA
ORDER TRANSFERING BUSINESS
In a significant
judgement, Securities Appellate Tribunal, (SAT), today, quashed the order dated
July 28, 2017 passed by Insurance Regulatory Development Authority transferring
the Life Insurance business of Sahara Life Insurance to an outside insurer,
namely – ICICI Prudential Life Insurance Co. Ltd.
SAT while allowing
Sahara's appeal, expressed serious concern over the manner Insurance Authority
acted in the matter against Sahara Life and considered the said action of
Insurance Authority highly fatal and irregular so as to vitiate the very
appointment of the Administrator and all his further actions, in the facts and
circumstances of the case. SAT opined that the report of the Administrator
should have at least been supplied to Sahara Life before passing the impugned
order.
Sahara Life
Insurance got a major respite and its stand was vindicated by SAT, when it
remanded and restored the whole matter to the file of the IRDA with a direction
to proceed from the stage of seeking a representation/response from Sahara Life
on the Administrator’s report in question as well as providing opportunity of being
heard to Sahara Life and its stake holders, in consonance with the principles
of natural justice and directing to complete the hearing as per law within
three monthsfrom the date of receipt of Sahara ’s reply to the Administrator’s
report in question as per law and after giving opportunity of hearing to them.
It was contended by
Sahara Life in the said appeal that the Insurance Authority had illegally and
with malafide intent transferred its business to an outside insurer, namely –
ICICI Prudential Life Insurance Co. Ltd. without affording any opportunity of
hearing to it and the Administrator appointed by the Insurance Authority was
acting in concert for the benefit of a third party, who recommended the other
options but unilaterally recommended for transfer of business.

My take on Think with Me
Subrata Roy Sahara knows how difficult it is to reach where he is,
success is always hard earned and being successful in a country like India is
even more difficult. Now, you must be wondering what a vague statement is that,
but let’s get deeper into it. Starting with the overpopulation, getting into a
good school, a better college is so difficult, there are times when even 99%
marks are not enough for getting into a college where you’ve always dreamed of
studying.
Citing the same problem of population, businessmen face a strong
competition and mind you this competition is cut-throat. And it is so, only
because there are lots of people doing the same business. Earning money in our
country is hard. How does one rectify this and make living in India a fairly
easy? We are constantly working hard and failing to be happy with our lives,
what will make this better?
When we look at the professionals in the western countries, we see
how well organized their lives are, how comfortably they reach work and come
home at the same time daily and spend time with their families. Unlike us, we
struggle to reach our offices, courtesy packed public transport, traffic or bad
roads. Most of us don’t ever leave office in time as all of us are over-worked
and burdened, doing work worth two employees. The list goes on and on.
Saharasri, in ‘Think with Me’, discusses population, education and
all the other factors he thinks, if fixed, will lead India in becoming a better
and ideal country! It’s a book, I highly recommend to all the people who keep
wondering where is our country going wrong and is not progressing as fast as it
should. Also, to all those people who consider themselves as concerned citizens.
‘Think with Me’ has given me a better understanding of our Country
and I will do my best to contribute to its betterment!

Why I want to read Saharasri’s ‘Think with Me’
After
reading ‘Life Mantras’ by Mr Subrata Roy
Sahara, I am a changed person. With all the
situation that he has been into and he has still maintained such a positive
attitude towards life, I am truly impressed and inspired by Mr Roy! This is my reason one for wanting to
read ‘Think with Me’.
Besides
this, I consider myself as a concerned citizen of India, and I work hard and
pay taxes, yet I see the country only going down the drain and not progressing
at all. If at all, there is any progress, it is slow as a snail or as invisible
as the wind. I totally fail to understand what is going on, I am reading about
other countries becoming a powerful
nation and don’t get me wrong, I read about India progressing too, launching
new satellites and making powerful nuclear ammunitions BUT what about the
common man like me? Our life is only becoming tougher and tougher, the roads
aren’t smooth, the public transport is always over-crowded and getting in good
education institute is almost getting next to impossible.
So, after
‘Life Mantras’, I have been looking forward to its sequel that is named as
‘Think with Me’. Saharasri is an extremely intelligent man, and this very
intelligence and his reasoning skills have made him the man that he is and
build an empire this big. I wanted to know how he thinks we can make India a
better country and I literally want to ‘Think with him’. He has discussed the
fundamentals of making India an ideal country, along with issues such population,
education system, media and religion, electoral system & leadership.
I am
sure, Mr Roy would’ve discussed these in
minute details and the book will give me a fresh perspective on why India isn’t
getting better for the common public and how to make it better.

Thoughts on ‘Think with me’ by Subrata Roy
With
great power comes great responsibility
“Success
is the result of perfection, hard work, learning from failure, loyalty, and
persistence.” Who doesn’t want to achieve success in life? Today, we all know
the importance of success. An individual is recognised in the society based on
his/her potential of success. When we take success to another tangent, it could
perhaps be a myth, not everyone likes to or wants to share their secret to
success. However, we always have exceptions. Highlighting the exception in this
article, he is none other than Subrata Roy. Possessing his own company, he is among those generous souls who shares
his secret to success. ‘Sahara’ is the company that was one among the first
Indian companies to have an evident global presence. Covering various sectors, Sahara
flourished to the fullest wherein millions of people were employed at one point of time.
“Think
with Me” by Subrata Roy is doing exceptionally well across. It emphasizes our
day-to-day concern in regards to political leadership, population growth,
education, the media and religion going from bad to worse. Don’t you want to
know what went wrong? Why are we facing these horrid problems? “Think with Me” is
an answer to all the above concerns. This book involves Mr Roy’s years of
experience where he discusses problems related to the above five fundamental
issues. He has liberally shared some of those experiences in detail throughout
the book. Along with it being an interesting read, it’s also a great guidebook that
values the sacred for the love of the country before independence.
Thus,
Mr Roy, through a deep-seated & thought provoking commentary on these
issues invites you to think along with him and muse over these issues honestly
and sincerely. Subrata Roy has been the man who takes responsibility for his
actions. In this book, he talks about the need for a wider awakening on the
issues mentioned above.

A gist of ‘Think with Me’ by Saharasri
Subrata Roy Sahara needs no introduction, the world has seen him
grow into the successful businessman that he is and in spite of all his
success, he has still managed to remain one of the humblest people you will
ever come across. What makes him stay so humble and positive in life is not a
secret, he has written a book on it called “Life Mantras”, which has been a
bestseller for a while too.
So, after ‘Life Mantra’ comes ‘Think with Me’, a book from
Saharasri’s trilogy. In ‘Think with Me’, he basically focuses on how to make
India, our country an ideal one. We all know how our country is facing problems
of various types, be it education, the religion and media degrading, political
leadership, over population, etc. We often end up wondering what is it that we
can actually do to make India a more livable place. Doubts like is the
democracy really not helping India become better? Why aren’t we progressing in
spite of so many efforts in the form of schemes, bills, laws etc.? Why aren’t
our leaders able to do anything to fix the situation and make our country
better?
Many young adults are indulging in a phenomenon known as ‘Brain
Drain’, because the overall lifestyle and stand of living in our country is
deteriorating with time as opposed to other countries which are only getting
bigger and better. This is definitely not going to do our country any good as
if you understand the situation, the brightest and most intelligent people are
educating themselves from India and when it is time to use this very education
and intelligence, they prefer to settle down in another country, adding to
their grown and overall improvement.
‘Think with Me’ is more of an eye-opener for many and even if
there will be some thoughts that you may not agree with, but the overall book
is something every concerned citizen of India will agree with.

Sahara to SEBI: Expedite investor verification, ads won't help
Hitting back at Sebi, embattled Sahara group today said issuance of advertisements would not help the regulator reach out to the investors spread across remote parts of the country and offered its help in verifying 95 per cent bondholders it claims to have already refunded.
"The proof of the pudding is in eating. Sahara is confident that verification will prove not only the existence of the investors but also Sahara will get all its money which is with Sebi," the group said in a statement.
This follows comments made by Sebi's Whole-Time Member S Raman yesterday on the sidelines of a conference in Mumbai, where he wondered why not many claimants were coming forward to get back the money in the high-profile Sahara case.
"As far as Sahara is concerned, we have a decent amount of money but not many claimants. That is a question mark, as to why there are no claimants despite the fact that we have made multiple advertisements seeking applications to pay the money," he had said.
Terming his comments as "misguiding and irresponsible", Sahara accused Sebi of indulging in 'media trial' on Sahara- Sebi matter when the case was 'sub-judice'.
It said the regulator was not finding many claimants because "Sebi in four years has not initiated on-ground verification of the investors".
The group further said that Sebi has issued four newspaper advertisements directed towards only those investors who have yet to get refund. But, "the majority 95 per cent who have already got back their money are neither addressed in these advertisements nor will they anyway, bother to reply to Sebi (even if asked) as they have already got their money refunded from Sahara."
"Besides, it is imperative to understand that almost entire majority of Sahara investors (including the remaining 5 per cent investors) reside in the remote parts of rural India and are mostly illiterate or barely literate.
"Many of them live in mud houses, hutments and even slums, where there are no street names or house numbers (as there are no municipalities in small villages to allot house numbers, etc). Therefore, instead of merely issuing advertisements, a more serious and detailed approach should be adopted by Sebi to reach out to our investors," it said.
The group further said "Sahara with its more than 12 lakh workers has an unparalleled reach to investors".
Citing the Supreme Court order that Sebi can take help of Sahara for verification of investors, the group said, "It is not possible to reach out to these small investors and Sahara is always ready to assist Sebi in reaching out to the aforesaid investors."
Sahara is engaged in a long-running dispute with the Sebi over schemes involving raising of funds from public through certain bonds and the group was asked to return thousands of crores along with interest to the investors through the regulator.
"The entire desire of ours is to distribute as much money as possible," Raman had said.
Reacting to Raman's comments about Sahara giving truckloads of documents not connected to one another and the regulator undertaking the gargantuan task of sifting through those, Sahara said the group was asked to send all the document pertaining to 3 crore investors to Sebi in 10 days.
"The OFCD (bonds through which money was raised) was not closed and in fact in process of refund to a large number of investors was on. In this scenario many of the document were at our head office while a big number of documents were at our more than 4,000 branches.
"Keeping in mind the time limit of 10 days, we collected all the original documents as it is from all our offices across India and had sent the same to Sebi is boxes through 127 trucks," Sahara said in a detailed statement.
Stating that there was no fault on Sahara's part, it further said, "The documents of 3 crore investors cannot be handful and quite understandably will be huge in number because it contains the proofs of repayments of three crore investors - original repayment vouchers, receipts, KYC and other relevant documents.”
"Further, Sahara had in fact offered Sebi to help in the collation of documents and stationed its 50 officials in Sebi's Mumbai office to assist the market regulator. We were even ready to increase the number of officials to many hundred, but Sebi has refused to take their help. "Moreover, Sebi refused to take around 25 per cent of the documents which are still lying in our warehouses in Mumbai," it added.
It further accused Sebi of not having made "any serious effort" to start the verification even after two years of having claimed to have successfully organized the documents.
It further asserted that verification of "documented proofs" provided by Sahara would prove that all its "investors actually exist".
The group said the amount deposited so far with Sebi is more than Rs 14,000 crore, including interest earned, and recently it has given additional Rs 500 crore, though Sebi has refunded only Rs 55 crore.

Life Mantras – a manual for positivity
The world at any given point of time is
filled with people that are successful and can teach about it to other people
so that they too can prosper. Many people have the capability to be that kind
of a person but those that actually care about the rest of us are few in
number. Mr Subrata Roy is a man that can be considered as a part of the latter
group. He is the former chairman of the Indian multinational conglomerate
‘Sahara Group’. ‘Sahara’ is a business empire with interests in various sectors
of business and the Subrata Roy is the man who built it from scratch!
He started the company with a few thousand
rupees in capital and not more than a few employees. In a relatively short
time, Subrata Roy managed to turn the fortunes of the company soaring skywards.
He took charge of the company and instilled a specific work ethic among his
huge workforce. He looked upon them as members of his extended family rather
than people that work for him. This philosophy is what guided him in his path
according to his informative book, ‘Life Mantras’.
Mr Subrata penned the book while he was
going through a major difficult time in life. Instead of focusing on the
negative aspects of his life, he chose to ruminate on the positive qualities in
life that made him a successful man and compiled them all into a single book,
‘Life Mantras’. It has some of the best advice to achieve a balanced and
positive outlook in life. Along with a positive outlook, the book is filled to
the brim with real life experiences of Mr Subrata that had an impact on him or
taught him the value of something important. These experiences have been drawn
from both his personal life and professional life.
The book has Subrata Roy’s thoughts on
almost all the important things in life like marriage, time, love, respect,
dedication, resilience, usefulness etc. The mix of topics is eclectic and it
has a wonderful effect on your personal motivation after just one reading
session.
